Premiere Partner Agreement

What this is

You are joining the Premiere Partner programme run by TFC The Financial Collective Ltd.. We give you access to a co-branded client page, a co-branded app, calculators, feature sheets, open-house tools and marketing materials. There is no charge. The programme exists because we work together — you refer clients who need a mortgage, and we support your business with these tools.

Either of us can end it at any time, for any reason, with no notice required and nothing owed.

These are tools, not advice

Everything we provide is information and productivity software. Nothing it produces is a mortgage approval, a commitment to lend, an offer, a rate guarantee, or professional advice — to you or to anyone you share it with. Using these tools does not make us your advisor, and it does not create any professional relationship between us and your clients.

Every figure is an estimate — check it before you use it

The calculators and sheets produce estimates from the information entered and from rates, tax tables and lending rules that change and may be out of date. You are responsible for checking any figure before you rely on it or give it to a client. Please do not present anything from these tools as a guarantee, an approval, or professional advice.

If a figure ever looks wrong to you, tell us. You are closer to the deals than we are, and we would rather hear it from you than from a client.

Your professional obligations are yours

You remain responsible for your own licensing, regulatory and brokerage obligations — including anything your brokerage requires you to have reviewed or approved before you put it in front of a client. We do not check your use of these tools for compliance with your obligations, and we are not responsible for it.

Your clients' information

Some tools store information about your clients — open-house sign-ins in particular. That information is yours; we hold it for you. You confirm you have the consent you need to collect it and to have us hold it. We handle it as set out in our Privacy Policy, and we will tell you promptly if anything ever goes wrong with it.

Where a tool calculates entirely in the browser, nothing is sent to us and we hold nothing.

What belongs to whom

The software, calculations, layouts, designs and our branding stay ours. While you are a Premiere Partner you may use them for your own business. You may not copy them, resell them, share your login, or pass these tools to another agent.

Your photograph, your brokerage's branding, your listings and your words stay yours. You give us permission to use them only to run these tools for you.

If the programme ends

Your access stops and your public page comes down. You may export your stored data for 30 days. Anything we produced for you that is already in a client's hands is yours to keep — but please stop using our branding and stop presenting the tools as available to you.

No warranty, and limited liability

These tools are provided as is. We do not promise they will always be available, error-free, or accurate, and we do not warrant any figure they produce.

Because this programme is provided at no charge, our total liability to you for anything arising from these tools is limited to $100. We are not liable for lost business, lost deals, lost data, or harm to your reputation. Nothing here limits liability that cannot be limited by law.

If your use causes a problem

If a claim is made against us because of how you used these tools, a figure you gave a client, or your own professional obligations, you agree to cover our reasonable costs in dealing with it.

Changes

We may update this agreement. We will email you, and continuing to use the tools means you accept the update. If you would rather not, tell us and we will close your access.

Governing law

This agreement is governed by the laws of Ontario and of Canada.
